Just finished listening to your 'I'm finished with Netflix' rant/podcast (Episode 178).  
One well-thought-out explanation of why Netflix probably had no choice but to split the DVD and streaming businesses apart is here:ttp://[ has to do with then 1908 'first sale doctrine' that applies to copyrighted material like DVD's, but apparently NOT to content streamed online.  Owners of digital content are apparently putting the screws to Netflix to make them pay content owners per subscriber, not by the number of times a title was actually streamed.
